The court system, up to the federal level, does not respect a New Jersey Walmart worker’s right to consume cannabis.
They sided with the bosses and owners of the multi-billion-dollar Walmart in a lawsuit brought by Erick Zanetich. He tried to get a job at a Walmart in South Jersey. Zanetich was supposed to get the job pending a piss test which he failed. When he didn’t get the job, he sued. Zanetich lost the suit last year and appealed.
“CREAMMA (The Cannabis Regulatory Enforcement and Marijuana Modernization Act enabling the adult-use market) does not expressly allow citizens to bring a private cause of action, such as a civil action, to remedy alleged employment discrimination suffered because of an individual’s use of cannabis. This conclusion recently was challenged and the Third Circuit confirmed that CREAMMA does not confer a private right of action,” the ruling found.
So, the court said the CREAMMA law does not give a worker the right to consume if they can’t sue a company for holding a piss test against them.
It seems the law needs to be amended as it often does.
Walmart and Weed
Zanetich was seeking a position in “asset protection.” He filed a lawsuit against the corporate giant in 2022.
While Walmart doesn’t want their workers smoking weed, that doesn’t stop them from hustling cannabis consumers by selling pro-weed clothes.
Walmart has hated its workers for years and this is only the latest example and not an exception. Most consumers are indifferent and like the low prices.
Workers and Cannabis Consumption
Similarly, a lot of construction jobs require a clean piss test to do them. It has been a point of concern among members of the New Jersey Legislature. They’ve taken the position of the employers who believe their employees are stupid and don’t know their limits.
Many do not want cops to consume cannabis because they fear it could make them sloppy and hurt their performance. However, after a lengthy court case and appeals, a police officer’s ability to consume cannabis in New Jersey has been preserved thus far.
While there are a lot of bad apples among police, many do want to help people and fight violent criminals. They deserve the ability to relax by utilizing cannabis instead of alcohol, which causes health problems.

But for jobs like this one, employers are allowed to dictate the lives of their workers.
